This notice is to inform the public that Hazardous Material Emergency Response Plans have been written by the Local Emergency Planning Committee of Ingham County.
Due to the Homeland Security under the Authority of Section 13(1) (y), information from the plans is limited to the name of the company, address and chemicals on site making sensitive parts of the plan unavailable to the public. This is due to the reason that if sensitive information was released, this would impair a local government’s ability to protect the security or safety of persons and property. These sections of the emergency plans are available to the public in accordance with Sections 302, 311, 312 and 324 of Title III of the Superfund Amendments and Reauthorization Act (S.A.R.A.) of 1986. Also available are the Material Safety Data Sheets (M.S.D.S.), lists.
Section 311 of S.A.R.A. Title III states that the owner or operator of a facility which is required to have a M.S.D.S. for a hazardous chemical under the Occupational Safety and Health Act of 1970 and subsequent regulations, is also required to submit a tier II report of such chemicals to each of the following entities: The appropriate Local Emergency Planning Committee, the State Emergency Response Commission and the Fire Department with jurisdiction over the facility.
Sections 311, 312 and 324 of SARA Title III and regulations 40 CFR 370.20, 370.21 and 370.30, published since the passage of the act, provide that any person may request in writing from a local emergency planning committee (LEPC) certain portions of the emergency response plan and a specific MSDS. The LEPC shall make this information available to the person making the request.
Written notices of availability, submitted as a follow-up to emergency notification of release of an extremely hazardous substance, may subsequently be published, if and when such a release has occurred.
Members of the public who wish to review certain sections of such plans, MSDS or follow-up emergency notice, may obtain a Public Request for Information from the office listed at the bottom of this notice. This office is open Monday through Friday excluding holidays, from 8:00 a.m. to 12:00 p.m. and 1:00 p.m. to 5:00 p.m. It is requested that an appointment be arranged for such a review. Copies of documents may be requested, using the same form. It may take up to 30 days to provide certain information. Reasonable fees are charged for copies of documents.
